General

• These Terms of Use (hereinafter referred to as the "Terms") govern the relationship between Whiteshaws Surplus Supplies Ltd, which operates the Platform, and the User.
• By registering or using the Platform, the User confirms that he/she has read, understood and agrees to comply with these Terms.

Definitions

In these Terms, the following terms are used in the following meaning:

• Platform — The website at whiteshaws.com, mobile and/or desktop applications, and all related services operated by Whiteshaws Surplus Supplies Ltd.
• User — An individual or legal entity who has registered on the Platform or uses it without registration.
• KYC (Know Your Customer) — Identity verification procedure to combat money laundering.
• AML (Anti-Money Laundering) — Policy against money laundering and counter-terrorism financing (CTF).
• Service Notifications — Mandatory messages related to account activity, security, and transactions.
• Marketing Messages — News, promotions, and offers sent to the User upon separate consent.

Account Registration

• Access to the personal account requires registration and email confirmation.
• The User must provide accurate data and keep it up to date.
• Creating or using more than one account by the same User is prohibited. If related accounts are detected, the Platform may merge them, limit their functionality, or suspend transactions pending verification.
• During registration, the User must confirm their agreement to receive email communications by checking the appropriate box. Messages include service notifications (transaction confirmations, security updates, legal notices) and informational updates about Platform features. The User may unsubscribe from marketing messages via support, but service notifications are mandatory for Platform use.

KYC and AML

• KYC verification is not mandatory. However, Users who do not complete KYC will not have full access to the affiliate program. KYC is also an added security measure to reduce the risk of unauthorized account or fund access.
• The Platform may limit transaction volumes or access to specific services as required by AML/CTF regulations or internal risk policies.
• The Platform reserves the right to request additional information to comply with legal requirements or internal policies. Refusal may lead to account restriction or suspension.

Affiliate Program

Users earn rewards for referrals in accordance with the conditions listed on the "Levels" and "Affiliate" pages in their personal account.

Spam traffic, misleading advertising, and infringement of third-party rights are prohibited.

Cryptocurrency Transactions

• All transactions are irreversible due to blockchain nature. The User is fully responsible for address and amount accuracy.
• Funds are not insured. Cryptocurrency rates may fluctuate sharply.
• Fees are applied as follows:
  1. Deposits: 0% (network fees paid by User)
  2. Withdrawals: 0%
  3. Exchange: 1% per transaction; 0% when using $MJT token
  4. Transfers: 0%

Cookies and Trackers

We use strictly necessary, functional, analytical, and marketing cookies. Users can manage these settings in their browser.

User Rights

Users have the right to:

• Obtain information about data processing.
• Request correction or deletion of data.
• Restrict processing.
• Data portability.
• Withdraw consent at any time.
• File a complaint with a supervisory authority.

Investment Risks and Disclaimer of Warranties

• Volatility & Liquidity: Digital asset prices can change rapidly.
• Regulatory Risk: Legal changes may affect or prohibit Platform use or specific services.
• Technological Risks: Blockchain, smart contracts, wallets, and the Platform depend on software, network infrastructure, and third parties. Issues may include hacking, bugs, hardware failures, or forks.
• No Insurance: User funds are not insured by government or private insurers unless explicitly stated.
• Tax Obligations: Users are solely responsible for calculating and paying any taxes related to cryptocurrency transactions in their jurisdiction.
• No Fiduciary Duty: The Platform is not a financial or investment advisor and holds no fiduciary responsibility. All information provided is for informational purposes only and is not personalized investment advice.

Prohibited Activities

Users agree to refrain from any actions that may harm the Platform, other Users, or violate the law, including but not limited to:

• Money laundering, terrorist financing
• Creating, spreading, or using malware
• Fraud, phishing
• Intellectual property infringement
• Using multiple accounts to bypass restrictions or gain unfair advantage (“multi-accounting”)
• Spam distribution

Violation of this section is considered material. The Platform may suspend or terminate accounts, freeze assets, or take other actions without prior notice, as outlined in the Suspension and Termination section.

Intellectual Property

• Ownership: All elements of the Platform—text, graphics, logos, trademarks, source code, design layouts, databases, and other materials (“Platform Content”)—are owned by Whiteshaws Surplus Supplies Ltd or its licensors and are protected under UK and international copyright and trademark laws.
• Copyright Notices: If you believe your protected material has been used in violation of copyright, send notice to copyright@whiteshaws.com with your contact information, a description of the work, and the URL of the disputed content. We will review and respond within 10 business days, including potential removal.
• No Circumvention of Protection: Users must not bypass, remove, or interfere with digital rights management (DRM), watermarking, or other technical protections applied to Platform Content.

Limitation of Liability

The Platform is not liable for losses resulting from third-party actions, force majeure, or misuse of the service.

Suspension and Termination

• The Platform may temporarily suspend or permanently terminate a User’s account in full or in part for reasons including:
  1. Violation of these Terms, Privacy Policy, or Affiliate Program rules
  2. Suspected fraud or illegal activity (e.g., money laundering, phishing, hacking)
  3. Failure to meet AML/CTF requirements or providing false information
  4. Official orders from courts, regulators, or law enforcement
  5. Significant technical security threats to the Platform

• Users may request account closure at any time via their dashboard or by emailing support@whiteshaws.com or support@whiteshaws.io. All assets must be withdrawn and investment activity completed before closure.
• Upon account closure (by either party), access to the dashboard is terminated, but personal data and transaction logs are stored for legally mandated periods under UK accounting and AML laws.

Dispute Resolution and Applicable Law

All disputes are to be resolved out of court first; response time is 30 calendar days. If unresolved, the dispute is subject to the courts of England and Wales.

Changes to the Terms

We may update these Terms; the revised version becomes effective upon publication. Continued use of the Platform indicates acceptance of the new Terms.
